Terms of Service
These Terms of Service govern your access to and use of CapturoAI, including our website, SaaS platform, AI receptionist system, dashboard, call handling tools, notifications, and related services.

By creating an account, subscribing to CapturoAI, accessing the dashboard, or using our services, you agree to these Terms.
If you do not agree to these Terms, do not use CapturoAI.
1. Overview of CapturoAI
CapturoAI is a multi-tenant AI receptionist SaaS platform for local service businesses.
CapturoAI helps businesses answer inbound phone calls, collect customer information, capture leads, generate call transcripts, store call recordings, and organize service requests in a business dashboard.
CapturoAI is designed for businesses such as cleaning companies, HVAC companies, landscaping companies, and other local service providers.
CapturoAI is not an emergency service provider, dispatch center, legal advisor, medical advisor, or replacement for professional judgment.
2. Who May Use CapturoAI
CapturoAI is intended for business users.
By using CapturoAI, you represent that:
- You are at least 18 years old
- You have authority to act on behalf of the business you register
- The information you provide is accurate and complete
- You will use CapturoAI only for lawful business purposes
- You will comply with all laws that apply to your business, industry, location, phone calls, customers, and communications
You are responsible for all activity that occurs under your account.
3. Description of the Service
CapturoAI may provide features such as:
- AI phone answering
- AI receptionist call flows
- Lead capture
- Caller information collection
- Call transcripts
- Call summaries
- Audio recordings
- Dashboard access
- Business settings
- Service configuration
- FAQ configuration
- Email notifications
- SMS notifications
- Call and lead history
- Service request organization
Features may change over time as we improve the platform. We may add, remove, modify, or limit features at any time.
4. Multi-Tenant Platform
CapturoAI is a multi-tenant SaaS platform. This means multiple businesses may use shared infrastructure, but each business account is designed to access only its own data.
You are responsible for:
- Managing who has access to your business account
- Keeping your login email secure
- Reviewing your dashboard data
- Configuring your business settings correctly
- Not attempting to access another business’s data
If you believe your account has been accessed without permission, contact us immediately.
5. Account Access and Authentication
CapturoAI may use magic link email authentication.
This means users may log in by receiving a secure login link by email.
You are responsible for keeping your email account secure.
Anyone with access to your email may be able to access your CapturoAI account.
You agree not to share login links, misuse authentication systems, or attempt to bypass account security.
6. Subscription Pricing
CapturoAI is offered on a subscription basis.
Pricing starts at $129 per month, unless otherwise stated in a separate written agreement, invoice, checkout page, or promotional offer.
Your subscription price may depend on your selected plan, usage, features, phone setup, call volume, integrations, or other service terms.
CapturoAI may update pricing at any time. If pricing changes affect your active subscription, we will provide notice where required or appropriate.
7. Month-to-Month Service
CapturoAI is provided month to month unless otherwise stated in writing.
There are no long-term contracts by default.
Your subscription renews automatically each billing cycle until canceled.
You are responsible for canceling your subscription before the next billing date if you do not want to be charged again.
8. Payment and Billing
By subscribing to CapturoAI, you authorize us or our payment processor to charge your payment method for subscription fees and applicable charges.
You agree to provide accurate billing information and keep your payment method current.
If a payment fails, we may:
- Retry the charge
- Notify you of the failed payment
- Suspend access to the platform
- Pause AI receptionist services
- Disable phone answering features
- Terminate your account if payment is not resolved
You are responsible for all charges incurred under your account.
9. Cancellation Policy
You may cancel your CapturoAI subscription at any time.
Cancellation stops future billing, but it does not automatically refund past payments.
After cancellation, your access may continue until the end of your current paid billing period unless otherwise stated.
We may also provide tools or instructions for account closure, data export, or data deletion where available.
To cancel, use the available account settings or contact us at support@capturoai.com.
10. Refund Policy
CapturoAI subscriptions are generally non-refundable.
Because CapturoAI is a software service with immediate platform access, phone configuration, AI setup, infrastructure usage, and ongoing system costs, we do not guarantee refunds for partial months, unused time, missed calls, lack of usage, or business results.
We may issue refunds at our discretion in limited cases, such as duplicate charges, billing errors, or other situations we determine appropriate.
Refund requests may be sent to support@capturoai.com. Submitting a refund request does not guarantee approval.
11. Call Recording and Consent Responsibility
CapturoAI may record calls, store audio recordings, generate transcripts, and process call content as part of the service.
You are responsible for complying with all laws that apply to call recording, call monitoring, consent, disclosure, telephony, customer communications, and data collection.
This may include giving callers notice that calls may be recorded and transcribed.
You are responsible for deciding whether this disclosure is sufficient for your business, callers, and operating locations.
CapturoAI may provide tools, prompts, or settings to support call recording disclosure, but you remain responsible for legal compliance.
You agree not to use CapturoAI to record calls unlawfully.

12. SMS and Email Communications
CapturoAI may send email or SMS notifications related to leads, calls, urgent requests, account activity, login links, platform updates, or service notifications.
You are responsible for making sure your use of SMS and email notifications complies with applicable laws and customer communication rules.
You agree not to use CapturoAI to send spam, unlawful marketing messages, misleading communications, or messages without required consent.
Message and data rates may apply for SMS messages.
13. AI Accuracy Disclaimer
CapturoAI uses AI technology to answer calls, understand caller requests, generate transcripts, create summaries, classify urgency, and extract lead details.
AI systems are not perfect.
CapturoAI may:
- Misunderstand callers
- Transcribe words incorrectly
- Summarize calls inaccurately
- Miss details
- Classify urgency incorrectly
- Ask incomplete or imperfect follow-up questions
- Produce incorrect or unexpected responses
- Fail to capture all caller information
You are responsible for reviewing call data, transcripts, summaries, leads, and dashboard information before relying on them. CapturoAI does not guarantee that every call will be answered perfectly, every lead will be captured, or every AI response will be accurate.
14. No Guarantee of Business Results
CapturoAI is designed to help businesses answer calls and capture leads more effectively.
However, we do not guarantee:
- More revenue
- More customers
- More booked jobs
- Higher close rates
- Better search rankings
- Better reviews
- Specific conversion rates
- Specific customer outcomes
- Uninterrupted phone performance
- Error-free AI conversations
Your business results depend on many factors outside our control, including your market, pricing, service quality, follow-up speed, availability, reputation, competition, and customer demand.
15. Third-Party Services
CapturoAI relies on third-party infrastructure and service providers.
Vapi
Used for AI voice assistant functionality, voice workflows, and AI call handling.
Twilio
Used for telephony, phone numbers, call routing, SMS, and related communication services.
Supabase
Used for database storage, authentication, backend infrastructure, and account-related services.
Other Providers
We may also use providers for hosting, email delivery, analytics, AI processing, security, and operational support.
Third-party services may experience outages, delays, errors, pricing changes, policy changes, or service limitations. CapturoAI is not responsible for failures caused by third-party providers, telecommunications networks, internet outages, carrier filtering, customer phone issues, or other systems outside our control.
16. Acceptable Use
You agree to use CapturoAI only for lawful business purposes.
You may not use CapturoAI to:
- Violate any law or regulation
- Record calls without required consent
- Send spam or unlawful communications
- Harass, threaten, abuse, or deceive callers
- Collect sensitive information unlawfully
- Impersonate another person or business
- Misrepresent your services
- Upload malicious code
- Attempt to access another customer’s data
- Interfere with platform security
- Reverse engineer, scrape, or copy the platform
- Overload, disrupt, or abuse the service
- Use the platform for fraudulent or deceptive activity
- Use AI outputs in a way that harms callers or customers
We may suspend or terminate accounts that violate this section.
17. Customer Data
You retain ownership of your business data and customer data.
By using CapturoAI, you grant us permission to process customer data as needed to provide the service.
This may include processing:
- Caller names
- Phone numbers
- Addresses
- Service requests
- Call recordings
- Transcripts
- Summaries
- Lead records
- Notification data
- Account settings
You are responsible for having the rights, permissions, and lawful basis needed to submit or collect this data through CapturoAI.
18. Data Retention and Deletion
CapturoAI may retain account data, call data, transcripts, recordings, lead records, logs, and related information as needed to provide the service, comply with legal obligations, resolve disputes, prevent abuse, and enforce these Terms.
You may request deletion of certain data by contacting us at support@capturoai.com.
Some information may be retained where required for legal, security, billing, backup, fraud prevention, dispute resolution, or compliance reasons.
Cancellation of your subscription does not always result in immediate deletion of all data.
19. Blog and Website Content
CapturoAI may publish blog content on the same domain.
Blog content may cover HVAC, home services, AI receptionists, business automation, lead capture, call handling, and related topics.
Blog content is provided for informational and educational purposes only.
It should not be treated as professional advice, legal advice, financial advice, technical repair instructions, or a guarantee of results.
You should consult qualified professionals before relying on blog content for legal, business, safety, or technical decisions.
20. Intellectual Property
CapturoAI and its related software, designs, content, branding, logos, workflows, interface elements, documentation, systems, and technology are owned by CapturoAI or its licensors.
You may not copy, modify, reproduce, distribute, sell, lease, reverse engineer, or create derivative works from CapturoAI without permission.
You may use CapturoAI only as allowed under these Terms and your subscription.
You retain ownership of your business name, business information, customer data, and content you provide to configure your account.
21. Feedback
If you provide feedback, suggestions, ideas, or recommendations about CapturoAI, you grant us the right to use them without restriction or compensation.
This helps us improve the platform.
We are not required to treat feedback as confidential.
22. Service Availability
We aim to provide a reliable service, but we do not guarantee uninterrupted access.
CapturoAI may be unavailable due to:
- Maintenance
- Software updates
- Third-party outages
- Internet or carrier problems
- Telephony issues
- Security incidents
- Bugs or errors
- High usage
- Force majeure events
- Infrastructure problems
We are not liable for losses caused by downtime, missed calls, delayed notifications, failed transmissions, AI errors, or service interruptions.
23. Platform Changes
We may modify, update, improve, limit, suspend, or discontinue parts of CapturoAI at any time.
This may include changes to features, pricing, integrations, call flows, dashboards, notifications, storage, or supported third-party services.
We may provide notice when changes are significant, but we are not required to provide notice for every update.
24. Suspension and Termination
We may suspend or terminate your access to CapturoAI if:
- You fail to pay fees
- You violate these Terms
- You misuse the platform
- You create legal or security risk
- You use the platform for unlawful activity
- Your use harms CapturoAI, callers, customers, or third parties
- We are required to do so by law or a service provider
You may cancel your account at any time. After termination, your right to use CapturoAI ends. Certain sections of these Terms will continue to apply after termination, including payment obligations, intellectual property, disclaimers, liability limits, data provisions, and governing law.
25. Disclaimers
CapturoAI is provided on an “as is” and “as available” basis.
To the fullest extent allowed by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
We do not guarantee that:
- The platform will be uninterrupted
- The platform will be error-free
- AI responses will be accurate
- Calls will always be answered
- Transcripts will always be correct
- Notifications will always be delivered
- The dashboard will always be available
- Third-party services will always function
- The platform will meet every business need
- The platform will produce specific business results
You use CapturoAI at your own risk.
26. Limitation of Liability
To the fullest extent allowed by law, CapturoAI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes damages related to:
- Lost profits
- Lost revenue
- Lost customers
- Missed calls
- Missed leads
- Lost business opportunities
- Inaccurate AI responses
- Incorrect transcripts
- Delayed notifications
- Service interruptions
- Data loss
- Third-party service failures
- Call recording compliance issues
- Customer disputes
To the fullest extent allowed by law, CapturoAI’s total liability for any claim related to the service will not exceed the amount you paid to CapturoAI in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain liability limits, so some limits may not apply to you.
27. Indemnification
You agree to defend, indemnify, and hold harmless CapturoAI, its owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of CapturoAI
- Your business operations
- Your violation of these Terms
- Your violation of laws or regulations
- Your failure to obtain call recording consent
- Your customer communications
- Your use of caller or customer data
- Your misuse of AI outputs
- Claims by your customers, callers, employees, contractors, or third parties
This means you are responsible if your use of CapturoAI creates a legal claim against us.
28. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any dispute related to these Terms or CapturoAI will be handled in the state or federal courts located in Florida, unless applicable law requires otherwise.
You agree to the personal jurisdiction and venue of those courts.
29. Changes to These Terms
We may update these Terms from time to time.
When we update the Terms, we will change the Effective Date at the top of this page.
If the changes are significant, we may provide additional notice through the website, dashboard, or email.
Your continued use of CapturoAI after updated Terms are posted means you accept the updated Terms.
If you do not agree to the updated Terms, you should stop using CapturoAI and cancel your subscription.
